Terms of Service

Welcome to Propxima. By using our platform, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using Propxima ("the Platform"), you confirm that you are at least 18 years old and legally capable of entering into binding agreements under the laws of Zimbabwe. If you are using the Platform on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

2. Platform Use

Propxima is a property listing and information platform designed to connect buyers, renters, agents, and developers in Zimbabwe. You agree to use the Platform only for lawful purposes and in accordance with these Terms and all applicable Zimbabwean laws and regulations. You may not use the Platform to post fraudulent or misleading listings, impersonate any person or entity, scrape or systematically extract data, or engage in any activity that disrupts or burdens the Platform.

3. Listings and Content

Users who post property listings are responsible for ensuring that all information is accurate, complete, and lawful under Zimbabwean property and consumer protection law. We reserve the right to remove any listing that violates these Terms or applicable law, without notice.

Propxima verifies the identity of listers and agents before granting them access to the Platform. This identity verification process is designed to reduce the risk of fraudulent actors but does not constitute verification of the accuracy, completeness, or legality of any specific listing. Users are encouraged to conduct independent due diligence before entering into any property transaction. Propxima expressly excludes liability, to the fullest extent permitted by Zimbabwean law, for any loss arising from reliance on listing content — including property descriptions, pricing, images, and availability — whether or not the lister's identity was verified.

By submitting a listing or any content to the Platform, you grant Propxima a non-exclusive, royalty-free licence to display, store, and distribute that content solely for the purpose of operating and promoting the Platform.

4. Agent Verification

The Propxima badge and verification programme indicates that an agent has met certain platform-defined criteria. Verification is based on platform data and activity and does not constitute an endorsement of individual agents or a guarantee of their conduct. Agents operating in Zimbabwe are separately required to comply with the Estate Agents Act (Chapter 27:17) and the requirements of the Estate Agents Council of Zimbabwe (EACZ).

5. Subscriptions and Payments

Subscription plans are billed in advance in United States Dollars (USD) or Zimbabwe Gold (ZiG) as displayed at checkout. Propxima reserves the right to change subscription pricing with not less than 30 days' notice to registered users. Refund requests must be submitted within 7 days of the billing date; refunds are evaluated on a case-by-case basis and are not guaranteed.

6. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference and is subject to the Cyber and Data Protection Act, 2021 (Chapter 12:07) of Zimbabwe.

7. Intellectual Property

All content on the Platform, including logos, design, and software, is the property of Propxima or its licensors. You may not reproduce, distribute, or create derivative works without our prior written permission.

8. Disclaimers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Propxima does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by Zimbabwean law, Propxima shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Platform, including loss of property transaction opportunities or reliance on listing information.

10. Account Suspension and Termination

Propxima reserves the right to suspend or terminate your account at any time if you breach these Terms or if required to do so by law. We will provide reasonable notice where practicable, except where immediate action is necessary to protect the Platform, other users, or third parties. Upon termination, your right to access the Platform ceases immediately.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Zimbabwe. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe. We encourage you to contact us first at legal@propxima.com to resolve any concerns before initiating formal proceedings.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes by email at least 14 days before they take effect.
